The leadership of the ruling All Progressives Congress has warned supporters of the immediate past Governor of Kogi State, Yahaya Bello, to desist from causing confusion in the party, saying the position of the national chairman is currently occupied.

The National Publicity Secretary of APC, Felix Morka, gave the warning at a press conference on Tuesday at the national secretariat of the party.

Online platforms and social media portals have been awash with rumours of Bello’s interest in the leadership position of the party, barely 48 hours after handing over to Governor Usman Ododo.

Posters of the former governor flooded the streets of Abuja, including the national secretariat of the ruling party on Monday.

But rising from the meeting of its National Working Committee, Morka reiterated that the position of the APC national chairman being peddled around by Bello’s supporters is currently held by a former governor of Kano State, Dr Abdullahi Ganduje.

He said, “There is no vacancy in the office of the APC National Chairman. Dr Abdullahi Ganduje remains remains our chairman. This is a democracy where people do what they want.

“We have total confidence in the leadership of the party. But, make no mistake because the office of the national chairman is properly and fully occupied. Nobody is asking for that office to be declared vacant and it is not vacant. I will want to warn those who are throwing these papers around to desist from doing that.

“That is not our priority right now. We need to concentrate on the job that needs to be done to solve some of the problems that will make our country a better place for all of us.”

Veteran Nollywood actress, Rita Edochie has warned her colleagues in the industry over their lifestyle.

One person has been confirmed dead while two others sustained different degrees of injury when a Toyota Camry car and a private motorcycle collided on the Lagos-Badagry Expressway on Tuesday.

The Commander of the Federal Road Safety Corps, FRSC, Badagry Unit, Mr William Manga, confirmed the incident to newsmen in Badagry on Wednesday, saying that it occurred at the Age-Mowo axis of the expressway at about 8.50pm.

“The accident involved a Toyota Camry car with registration number FST 81 FN and a private Bajaj motorcycle.

“Our personnel got to the scene of the accident at exactly 9.00pm.; three persons were involved in the accident.

“The motorcyclist died instantly while two others in the Camry car sustained injury.

“Two of the victims were immediately rushed to General Hospital in Badagry for treatment while the corpse of the motorcycle rider was deposited in the hospital’s mortuary,” he said.

Manga called on motorists plying the Agbara-Badagry expressway to be conscious of the single lane being used by road users.

He urged all motorists to adhere to speed limits and conduct routine vehicle checks on their vehicles, for prompt detection and replacement of faulty parts.

Insecurity: Senate to meet Tinubu, security chiefs
The Senate on Tuesday said it would meet President Bola Tinubu next week over rising insecurity across the country.

The lawmakers said the meeting with Tinubu will follow its planned meeting with the security chiefs.

The Edo State Police Command said it has arrested four suspected kidnappers in Kano State after allegedly collecting ransom from their victims in Edo.

The Public Relations Officer of the command, SP Chidi Nwabuzor, who disclosed this to newsmen, said the suspects were arrested by the Anti- kidnapping and Cyber Crime Unit of the command.

Nwabuzor gave the names of the four suspects as Aminu Sadio (24), Umar Aminu (22), Adamu Abubakar (30) and Adamu Tahir (30).

He said the police received a report of the kidnap of four persons at Fugar in Etsako Central Local Government Area of Edo State on January 23 and the alleged collection of ransom by the kidnappers through Union Bank and Moniepoint, respectively.

The command’s image maker said the police, using intelligence-based investigation, arrested Aminu Sadio and Umar Aminu, owners of the two accounts that received the ransom.

He added that the arrest of the duo led to the arrest of other two accomplices, namely, Adamu Abubakar and Adamu Tahir.

He said an investigation has commenced and that the suspects will soon be charged in court.

The Governor of Lagos State, Babajide Sanwo-Olu has approved the appointment of Major Olaniyi Olatunbosun Cole (retd.) as the new Corps Marshal of the Lagos State Environmental Sanitation Corps Agency also known as Kick Against Indiscipline Brigade.

Also, the governor appointed Adefemi Afolabi as General Manager of the Lagos State Waste Water Management Office.

The appointments of the duo took effect on January 25, 2024.

A statement signed by the Director (Public Affairs) Ministry of Environment and Water Resources, Kunle Adeshina, on Tuesday, added that Sanwo-Olu also approved the appointment of three new Deputy Corps Marshals for LAGESC.

The newly appointed officers are: Mr Osifeso Olusegun Shakiru – Intelligence and Monitoring; Mr Oyenola Koyejo Quadril – Discipline and Welfare; Mr Apena Idowu Yisa – Admin.

“The appointment of the three new Deputy Corps Marshals, two of whom were elevated from the LAGESC/ KAI personnel also took effect from January 25, 2024.

“The Head of Service enjoined the new appointees to demonstrate a high level of dedication, diligence and selflessness in the discharge of their duties to justify the confidence and trust of Mr Governor,” Adeshina said.

8,285 candidates registered for maiden computer-based-WASSCE, says WAEC
The Head of National Office, West African Certificate Examination, Nigeria, Dr Amos Dangut, said as of Monday, 8,285 candidates have registered for the first series of Computer Based-West Africa Senior School Certificate Examination for private candidates, 2024.

Speaking at a press conference in Lagos on Monday, Dangut revealed that the examination would take place from Wednesday, January 31 and end on Saturday, February 17, 2024, across Nigeria.

In November 2023, the council, in a press release, announced that it had concluded plans to conduct its WASSCE for private candidates, using the computer-based model.

Dangut said the council was aware that the news of this innovation was initially greeted with some level of resistance, saying, “This only served as fuel for the council to forge ahead on its course to conduct the CB-WASSCE.”

He added that however, the council was encouraged by the acceptance of the innovation as evidenced in the number of entries received so far.

“As of today, Monday, January 29, 2024, a total of 8,285 candidates from across the federation have registered for the examination.

“Out of this number, 3,949 are male, representing 47.66% while 4,336 are female, representing 52.3% of the total candidature,” he said.

Dangut explained that candidates would be examined in 19 subjects, made up of 26 papers in a hybrid mode.

“Plans have, therefore, been concluded for this first-ever computer-based examination, which will be delivered in hybrid mode. The hybrid mode entails that, the objective or multiple choice questions will be rendered on-screen and candidates are required to give their responses on the screen.

“The essay and practical questions will be rendered on-screen, likewise, but candidates will be required to give their responses using the answer booklets provided,” he said.

He called on candidates to visit WAEC’s e-learning portal for materials that would demonstrate to candidates, the requirements for the conduct of the CB-WASSCE.

“We are set for the conduct of CB-WASSCE for private candidates, in 2024.

“We have and will always work hand-in-hand with the Federal Ministry of Education, the various State Ministries of Education, the Nigeria Police Force, other security agencies and stakeholders, to deliver, as usual, a credible examination to the Nigerian child and the general public,” he declared.

Military airstrikes killed 30 terrorists in Kaduna -NAF
The military air component of Operation Whirl Punch has killed 30 terrorists on motorcycles in the Birnin Gwari Local Government Area of Kaduna state.

The air strikes were ordered by the military following an intelligence report which disclosed the movement of the terrorists in the area.

A statement on Monday by the Director of Public Relations and Information, Air Vice Marshal Edward Gabkwet, said the eliminated terrorists were responsible for the ambush on troops at Kwanan Mutuwa recently as well as several attacks and abduction of innocent civilians in the LGA.

The statement read, “In its relentless campaign to rid the Northwest and Northcentral region of Nigeria of the menace of terrorism and Kidnapping, the Air Component of Operation Whirl Punch has eliminated a syndicate of terrorists in Kaduna State.

“The strike followed an intelligence report of the movement of the syndicate along the Kwiga-Kampamin Doka axis in Birnin Gwari LGA of Kaduna State.

“The intelligence also revealed that the same syndicate was responsible for the ambush on troops at Kwanan Mutuwa on January 27, 2024, as well as several attacks and abduction of innocent civilians in Birnin Gwari.”

He added that when the troops arrived at the location, two armed terrorists were sighted on 15 motorcycles.

He said “On arrival at the suspected location, a deliberate and detailed scan revealed a trail of terrorists sighted moving in a convoy of about 15 motorcycles, each with at least two armed terrorists.

Court adjourns Nnamdi Kanu’s N50bn suit against FG till April 22
The Federal High Court in Abuja has adjourned a suit by the leader of the Indigenous People of Biafra, Nnamdi Kanu, against the Federal Government until April 22, 2024.

Kanu in the suit marked FHC/ABJ/CS/462/2022 accused the FG of kidnapping him from Kenya and bringing him to Nigeria for trial.

He also wants an order for his release from the Department of State’s custody.

Kanu asked the court to order the FG to pay him N50bn as damages.

Other reliefs sought by him include, “whether by the operation of Section 15 of the Extradition Act Cap E25, Laws of the Federation of Nigeria 2004, the plaintiff can be competently/legally tried for offences stated in counts 1 to 14 of the 15-count amended charge in charge number FHC/ABJ/CR/383/2015 between the Federal Republic of Nigeria v. Mazi Nnamdi Kanu.

“Whether the way and manner in which the plaintiff was abducted in Kenya and extraordinarily renditioned to Nigeria is consistent with extant laws.”

Particularly, he cited “the provisions of Article 12 (4) of the African Charter on human and peoples rights (ratification and enforcement) Act Cap A9 laws of the Federation of Nigeria, 2004, and Article/Part 5 (a) of the African Charter’s principles and guidelines on human and peoples’ rights while countering terrorism in Africa.”

However, in the preliminary objection filed by the FG and AGF, they described the suit as an abuse of the court process, urging the court to dismiss its process.

The defendants held that Kanu had filed an earlier suit with similar facts before a Federal High Court in Umuahia.

At the proceedings on Monday, Aloy Ejimakor informed the court he had taken over the case from Mike Ozekhome (SAN).

The trial judge, Justice Inyang Ekwo, directed the Ejimakor to find out if a similar matter was not before a sister court or if a judgment had been delivered in a similar suit.

The judge ordered that a hearing notice be issued and served on the defendants who were absent at the proceedings on Monday.

Uzodinma, 14 other governors under scrutiny for LGA Administration breach
At least 15 governors are in breach of Section 7 of the 1999 Constitution of the Federal Republic of Nigeria, as amended, DAILY POST findings have shown.

They include Benue, Kwara, Cross River, Anambra, Akwa Ibom, Abia, Kogi, Osun, Plateau, Imo, Ondo, Bayelsa, Yobe, Bauchi and Sokoto states.

Section 7 of the Constitution aptly provides that “The system of local government by democratically elected local government councils is under this Constitution guaranteed; and accordingly, the government of every state shall, subject to Section 8 of this Constitution, ensure their existence under a Law which provides for the establishment, structure, composition, finance and functions of such councils.”

DAILY POST findings show that at the moment, no fewer than 14 governors obtained approvals from their respective state Houses of Assembly and constituted caretaker committees in place of elected chairmen.

Late last year, the Senate asked the Federal Government to block statutory allocations to any local government council not democratically elected.

The Red Chamber unanimously resolved that this move would deter the dictatorial tendencies of state governors.

The resolution was sequel to a motion moved by Sen. Abba Moro on the urgent need to halt the erosion of democracy vis-a-vis the dissolution of elected councils in Benue State.

The lawmakers argued that the placement of Caretaker Committees to replace Elected Councils is an aberration, undemocratic and a breach of the constitution of the Federal Republic of Nigeria (as amended).

Senator Victor Umeh (representing Anambra Senatorial district), who seconded the motion, lamented that the issue has continued to undermine the local government system in Nigeria.

Consequently, the Senate condemned the arbitrary dissolution of democratically elected local government councils in Benue and other federation states.

To save the face of Nigeria’s democracy, the Senate urged Alia to adhere to his oath of office, obey the rule of law, review the constitution of caretaker committees, and reinstate the elected councils.

But Alia is not alone on this. Many of his colleagues are involved in the said unlawful act.

Many concerned Nigerians are worried that despite the clear provision of the constitution and even court judgements, the governors have continued to observe that section in breach.

Several court pronouncements have held that the use of caretaker committees was in conflict with section 7(1) of the 1999 constitution.

However, even some of the governors who used the conduct of local government elections as part of their campaign promises, reneged once they got elected into office.

This is not the first time efforts have been made to preserve the constitutional roles of the local government councils.

It could be recalled that former president Muhammadu Buhari had at a time signed an executive bill mandating the direct payment of statutory allocation to the state judiciary, legislature and the local government councils.

Till date, many state governors are hellbent on running the council areas with caretaker committees.

Evidence of corporate malfeasance is said to abound in the handling of LG funds by many governors, with the local government chairmen always crying in silence for fear of victimization.

The Socio-Economic Rights and Accountability Project, SERAP, does not agree less.

Like many other Nigerians, it is worried over the level of financial sleaze being perpetrated with the local government system.

In a Freedom of Information, FOI, request signed by SERAP’s deputy director, Kolawole Oluwadare, the organisation is urging the Independent Corrupt Practices and Other Related Offences Commission, ICPC, and the Economic and Financial Crimes Commission, EFCC, to investigate the actual disbursement and spending of federal allocations meant for local governments in the states and the FCT since May 1999.

SERAP also agreed that the governors pocket a larger chunk of the money allocated to the LGAs on a monthly basis.

It expressed sadness that “allegations of corruption and mismanagement of federal allocations meant for local governments have contributed to widespread poverty, underdevelopment and lack of access to public goods and services in several states.

“According to our information, the 36 states in Nigeria and the federal capital territory, Abuja, have collected over N40 trillion federal allocations meant for the 774 local governments areas in the country and FCT.

“SERAP notes that former president Muhammadu Buhari recently alleged that state governors routinely pocket or divert federal allocations meant for local governments areas in their states.

“According to Buhari, ‘If the money from the Federation Account to the State is about N100 million, N50 million will be sent to the chairman but he will sign that he received N100 million. The chairman will pocket the balance and share it with whoever he wants to share it with.’”

However, many Nigerians, including the Senate, feel the time has come for the federal government to take decisive action against the recalcitrant governors.

Some observers say the Houses of Assembly deserve more knocks as they aid and abet the illegality instead of chastising the governors.

Professor Frank Asogwa of the Enugu State University of Science and Technology, ESUT, has strong words for the governors.

The professor of law described the action of the state chief executives as an affront to the constitution, stressing that it stifles democracy.

“It is not just unconstitutional but illegal in the sense that the Supreme Court has made a pronouncement on that issue and declared caretaker committees of local government areas illegal,” he told DAILY POST in an interview.

Asogwa added that, “If you do not have a democratically elected local government system, then you are in breach of Section 7, which says that a democratically elected system of local government must at all times be maintained.

“You cannot have democracy at the federal level, democracy at the state level and fail to also have democracy at the third tier of government, even though as an academic I don’t believe there is a third tier of government.

“There are just two tiers- federal and state governments, because the other one is an appendage of state, that is why the constitution said a democratically elected local government system must be assured by who- by the state government.

“That’s why the state governor appoints the chairman of the state electoral commission and this chairman in consultation with the governor, who is the chief executive, determines when, how and if local government elections will be held.

“So, it is not right actually because it stifles democracy at that level.

“Elections at the federal and state levels do not depend on the whims and caprices of who is the head of state, the president of Nigeria or who is the governor.

“There is an independent umpire we know as INEC that organises elections for both federal and state. So, why is SIECs not that independent to say after two years, depending on the state, we are going to conduct an election in the local government?”

The university don, who served as commissioner for local government during the administration of ex-governor Sullivan Chime in Enugu State, equally blamed the sad development on governors’ desire to divert funds meant for the local governments.

He said, “The other reason which is not always spelt out is that the governors who don’t hold elections find it convenient to divert local government funds.

“There has been so much talk about the autonomy of the local government, not just in terms of exercise of power, but autonomy in terms of budgetary provisions and allocations coming straight from the FAAC.

“But some governors opposed it; they don’t want it, because it is convenient for them that the money comes into a central purse and then they decide what goes to the local governments; for some, they allow the funds go to the local governments and determine how much they pay back to the state coffers and they call it joint account or whatever, which is unconstitutional.

“The constitutional thing is what I did when I was commissioner for local government in Enugu State. The law established the State Economic Planning Commission.

“All the local government chairmen are supposed to be members because the law is there; I was there as a member of that commission by virtue of my portfolio as local government commissioner; we had the commissioner for finance, the commissioner for works, we had commissioner for planning Enugu State and other commissioners who were relevant to the development of the local government system.

“At that level, we took decisions on projects affecting local governments; that was how the Nike-Ugwuogo-Opi-Ikem Road was built, because Nsukka, Isi-Uzo and Enugu East Local Government contributed 10 per cent of the fund for the building of that road and the state government contributed 70 per cent.

“I did a memo to the state executive council that time suggesting this ratio and it was approved.

“If any governor is sincere about local government funds, he should go through the Economic Planning Commission, where the local government chairmen are also members and introduce projects.

“So many governors are reluctant to remove their grip on the local government system in spite of what the constitution says.

“In different fora, I have asked this question to state representatives- how would you feel if the federal government strangles the state governments the way they are doing the local system? And they have no answer.”

He, however, said the Senate motion was not enough to end the illegal activities of the governors.

According to him, “the Senate should back it up with a law; the local government system is a creation of law so you cannot by resolution dictate what should happen to them. It will be illegal also to do so; two wrongs cannot make a right.

“If the National Assembly feels very strongly about what the governors are doing, let somebody propose a bill which should be passed at both the Senate and the House of Representatives.

“It’s just like local government autonomy, let them have a strong law backing it up. When that happens, a local government can challenge a governor if he does anyhow, but they cannot do it now for fear of being removed.

“In my conclusion, I repeat that the practice of not holding local government elections is unconstitutional, it is illegal and an affront to democracy in this country.”

Also Airing his views, a former member of the Enugu State House of Assembly, Rt Hon Chinedu Nwamba told DAILY POST that it was wrong for governors to remove elected chairmen and councillors merely because they are not from the same political party.

He equally said the conduct of local government elections was mandatory except in special circumstances.

While using Enugu as a case study, Nwamba said, “there is a court order, for other states, I don’t know what the problem is.

“But in Enugu, from the time of Sullivan Chime, there has always been elected local government chairmen, it only happened in a few cases during the Ifeanyi Ugwuanyi administration when there was a little break and they had caretaker for a few months and after that, election was conducted.

“I’m sure the incumbent governor will also conduct local government elections.

“Coming to other states, I don’t know the reasons given to the Houses of Assembly to expressly approve caretaker committees; their own case might be different from that of Enugu.

“Another school of thought says the governors may want to be in control of the funds of the local governments and that is why they are using caretaker, because once there are elected chairmen and councillors, the councillors now approve the budget of the local government.

“The constitution said the state government through the House of Assembly should supervise the local governments but that should not amount to non-conduct of elections; they also have a joint account, which is JAAC; apart from that, I will say that the local government should fully be on their own, that is where the lacuna is.”

He also said the dissolution of elected chairmen by new governors was equally illegal.

“It is totally unconstitutional and the Houses of Assembly should not approve of it; if an elected local government chairman is in office and a governor comes in, maybe they are not from the same political party, and the governor dissolves them, it is not right.

“There are reasons for an elected chairman to be removed and there are procedures and measures. It is either through impeachment, resignation by himself or he got another appointment.

“So, it is not constitutional to remove an elected chairman or councillor just because the person is not in the same political party with the governor.”

On his part, a rights activist, Barr Olu Omotayo accused the various state Houses of Assembly of promoting illegality.

Omotayo, the President of the Civil Rights Realisation and Advancement Network, CRRAN, said the state lawmakers err in law when they approve caretaker committees for governors despite the clear provisions of the constitution and the Supreme Court judgements.

The lawyer was concerned that the state lawmakers who should sanction the governors for breaching Section 7 of the Constitution were the same ones approving the illegal caretaker committees.

He advocated for citizens’ awareness and action.

According to him, “some of these things, the citizens have concentrated so much attention on the federal unlike in advanced countries, where people focus more on the grassroots

“So, the mentality over the years, we used to focus on the federal government without asking questions, forgetting that development only comes from the grassroots.

“Democracy was brought, this federalism was brought so that from the grassroots it goes up, but we are turning it upside down, we believe it is from up to down.

“And the American model we are using, it is from down you go up; many people in America don’t even know who is their president but they know their councillor; if they have any complaint, they go to their councillor.

“Until we change that mentality and start asking questions, local governments will not function.

“It is a constitutional provision; postponing elections when there is a constitutional provision that there must be local government is a grave infraction on the constitution.

“Only that the citizens have not been living up to expectations in this democracy; the constitutional provision is mandatory, the democratically elected local governments must be there.

“When you postpone elections, who will be operating? The Supreme Court has ruled that caretaker committees they are appointing are unknown to law.

“You cannot continue illegality in a democracy and think that things will work well.”

On the role of the state lawmakers, Omotayo said, “whatever they are doing is illegal because if the constitution says there must be elected local government, if they make a law or approvals contradictory to the constitution, the position of the law is that the constitution must prevail.

“Whatever law they make is null and void to the extent of its inconsistency with the constitution. So, whatever they are making is unlawful and unconstitutional.”

Reinforcing this stand, the President of the Nigeria Union of Local Government Employees, NULGE, Ambali Akeem Olatunji, identified corruption as the primary impediment to the realisation of local government autonomy in the country.

Olatunji, who spoke during his visit to Taraba State attributed the resistance to change to those benefiting from corruption.

He emphasised that the persistent challenges in local government administration stem from certain political actors in states who engage in the pilfering, diversion, and theft of local government allocations.

He also identified a flaw in the 1999 Constitution, which he said placed the local government areas under the state Houses of Assembly.

He accused state legislatures of being coerced by various state governments to enact illegal laws.

Highlighting the constitutional guarantee of democratically elected leaders, Olatunji denounced the appointment of caretakers.

He said, “NULGE is now advocating for federal intervention in states that refuse to conduct local government elections.

“We are proposing the seizure of local government allocations by the federal government.”

He said salaries should be directly deposited into workers’ accounts using the National Identification Number, NIN.

DAILY POST reports that some of the states running the local government councils with elected chairmen include- Ebonyi, Enugu, Delta, Kaduna, Adamawa, Niger, Nasarawa, Lagos, Ogun, Yobe, Kebbi, Jigawa, Katsina, Kano, Rivers, Oyo, Edo, Delta, Borno and Ekiti.

Below are some of the governors who seem unwilling to conduct council polls:

ANAMBRA

Anambra is one of the worst states in terms of non-conduct of local government elections.

No wonder the people of the state were delighted when the incumbent governor, Prof Chukwuma Soludo, while campaigning for the position in 2021, promised a speedy conduct of elections at the grassroots.

The last local government election in the state was held during the twilight of the Peter Obi administration in January 2014.

Many had blamed him for remembering to do so only when his administration was winding up, but at least he did.

For eight years, former governor, Chief Willie Obiano failed to conduct the election, heightening the quest for it.

During the last governorship election in the state, it was obvious that only one who supported the conduct of the election may get the people’s votes.

Prof Soludo cashed in on that. He promised that if elected, the local government election would be one of his priorities.

On March 17, Soludo will be two years in office. There has been constant prodding by opposition parties for the governor to hold election, but many believe that there is nothing on ground to show that Soludo is ready for it.

While there is no constituted electoral body, the lawmaker representing Awka South 1 constituency in the House of Assembly, Henry Mbachu, during the presentation of the 2024 budget, lamented the absence of budgetary allocation for the conduct of LG polls.

He said: “Going through the budget estimate presented, it is glaring that there are no intentions of conducting LGA elections next year (2024).

“On page 475, the budget for the Anambra State Independent Electoral Commission for this current year was N89,120,000, while the projected estimate for the incoming year is N129,120,000.

“You find out that there’s no feasibility or readiness for local government elections for the incoming year. I worry so much because this tier of government has suffered so much because of a lack of local government elections.”

Meanwhile, a human rights activist, Mr Kenechukwu Kodili, who spoke to DAILY POST, lamented that Soludo was already disappointing the people by reneging on the conduct of local government elections in the state.

He said: “For close to two years of being the governor, all he (Soludo) does is renew the tenure of the caretaker local government chairmen every three months.

“That was not what he promised the people. He was himself elected into the governorship seat, he should also conduct elections to elect local government chairmen, not to keep renewing the appointment of those he appointed.”

KWARA

For the past four years, the Kwara State government has administered local government areas with caretaker committees.

It could be recalled that the democratically-elected council chairmen were sacked in 2019 by the All Progressives Congress-led government, triggering a legal dispute that terminated at the Supreme Court.

Goalkeeper Lionel Mpasi scored the 18th penalty of a nerve-shredding shoot-out as DR Congo produced the latest shock at the 2023 Africa Cup of Nations by knocking seven-time champions Egypt out to reach the quarter-finals following a 1-1 draw after extra time.

DR Congo went ahead for the first time at the finals when Meschack Elia nodded in Yoane Wissa's cross to put the team ranked 67th in the world on course for the latest surprise result at a tournament which has been illuminated by underdog success in Ivory Coast.

Ibadan explosion: Atiku commiserated with Oyo, aide replies Makinde
The Media Aide to 2023 Presidential candidate Atiku Abubakar, Paul Ibe, has countered the Oyo State Governor, Seyi Makinde, stating that Atiku, contrary to his claim, commiserated with the people and State Government over the Ibadan explosion.

On January 16, an explosion occurred in Ibadan, resulting in fatalities, numerous injuries, and significant damage to properties valued in millions of naira.

Makinde on Monday, while hosting the presidential candidate of the Labour Party, Peter Obi, at the Governor’s Office in Ibadan, lamented that, unlike others, Atiku had not called or sent a message to commiserate with the people of the state regarding the explosion in Ibadan.

Makinde stated “I am particularly grateful because the musketeers that went for the presidential election have reached out to me. The president has called me, and you have reached out to me, but my party candidate, Atiku Abubakar, has not called or even sent a text message.

“And I am saying it openly, so that our leaders will know that there is time for politics, you have a time for governance and you have a time for humanity. So, we want to say thank you so much, sir. We appreciate this visit.”

Reacting, Atiku, in a statement by his media adviser on Monday, clarified that the PDP’s 2023 Presidential candidate commiserated with the victims, people, and the State Government. He added that Makinde may have been too busy to keep track of media reports on the incident.

The statement read in part “With due respect to Governor Seyi Makinde, we wish to correct his expression about the response of His Excellency Atiku Abubakar to the recent explosion in the city of Ibadan.

“Atiku Abubakar made a condolence message about the Ibadan explosion, less than 24 hours after its occurrence, where he shared his commiseration and empathy with the good people and government of Oyo State over the incident.

“Perhaps the Governor has been too busy to take track of media reports on the incident. But we wish to put on record that on the 17th of January, His Excellency Atiku Abubakar did make a widely available message on the Ibadan incident.”

Verification by our correspondent indicates that Atiku did, on January 17, express condolences through his verified Facebook page to the people and government of Oyo State concerning the blast.

Atiku in his Facebook post of January 17 said “I wish to express my condolences to the good people and government of Oyo State over the explosion that rocked the capital city of Ibadan late yesterday night.

“While the government continues to provide humanitarian support to victims of the explosion, I commiserate with the families of those who might have lost their lives and property to the explosion.”

Bayelsa keeps mum on palliative diversion probe
The Bayelsa State Government has kept mum on its investigation of the alleged diversion of fuel subsidy removal palliatives during the distribution of food items in the state, about two months after instituting a committee to carry out the task.

There are concerns in some quarters that barely two weeks to the end of Governor Douye Diri’s first tenure in office, nothing had been heard concerning the work of the probe panel.

A Government House statement signed by the Chief Press Secretary to the Governor, Mr Daniel Alabrah, had announced the setting up of the committee on November 30, 2023, “with a view to bringing to book culprits who diverted food items.”

It stated that Diri ordered an investigation into the palliatives diversion during the state’s executive council meeting in Government House, Yenagoa, “following complaints that some individuals diverted items meant for each ward in the state.”

Diri directed the Secretary to the State Government, Gideon Ekeuwei, Coordinator of the state Community Safety Corps, Brig-Gen. Eric Angaye (retd) and the acting Chief of Staff, Government House, Peter Akpe, to work with relevant bodies to identify those culpable.

The government claimed that it had procured more food items in addition to the five trucks of rice allotted to each state by the Federal Government as part of the measures to cushion the effect of the removal of petrol subsidies on people of the state.

Each of the 105 wards, the statement said, was allocated at least 150 bags of rice apart from maize.

Diri said, “Concerning the palliatives that I directed should be shared, I received reports that some greedy politicians converted some of them to their use.

“I have asked for an immediate investigation and anyone found wanting will face the wrath of the law, particularly those that are appointees. You were asked to share 150 bags of rice; you went with 80 or 100 bags to your people in the wards and villages. You cheat on your people.

“The SSG, the Coordinator of the Community Safety Corps, and the Chief of Staff should investigate through BYSEMA (Bayelsa State Emergency Management Agency) those who were in a position to distribute the palliatives to stakeholders in the wards and local government areas.

“Confirm how many bags got to each ward and how they were distributed. We distributed not only rice but also maize. I heard that some were sold. I want to have that report. Work through all the commissioners, members of the House of Assembly, and leaders. All of those involved will be brought to book.

“We must work assiduously not to disappoint our people. God has placed this assignment on our hands. Let us not be greedy. Whatever that should be given to the people, you must make sure it gets to them.”

He also decried the fact that some politicians were selfish in their conduct by withholding the palliatives that were meant for people at the grassroots.

However, about 60 days after the governor’s directive, neither the outcome of the investigation nor the conclusion of the committee’s task had been made public.When contacted on Monday, the governor’s media aide directed our correspondent to the SSG’s office.

But an Information Officer in the office of the SSG, who identified herself simply as Ine, said, “I can’t give you any information on the report of the committee because I don’t have it, and I’m not privy to it.”

The SSG could not be reached for a reaction even as a member of the committee and acting chief of staff to the governor, Peter Akpe, did not answer a call placed to his phone.

8,285 candidates registered for maiden computer-based-WASSCE, says WAEC
The Head of National Office, West African Certificate Examination, Nigeria, Dr Amos Dangut, said as of Monday, 8,285 candidates have registered for the first series of Computer Based-West Africa Senior School Certificate Examination for private candidates, 2024.

Speaking at a press conference in Lagos on Monday, Dangut revealed that the examination would take place from Wednesday, January 31 and end on Saturday, February 17, 2024, across Nigeria.

In November 2023, the council, in a press release, announced that it had concluded plans to conduct its WASSCE for private candidates, using the computer-based model.

Dangut said the council was aware that the news of this innovation was initially greeted with some level of resistance, saying, “This only served as fuel for the council to forge ahead on its course to conduct the CB-WASSCE.”

He added that however, the council was encouraged by the acceptance of the innovation as evidenced in the number of entries received so far.

“As of today, Monday, January 29, 2024, a total of 8,285 candidates from across the federation have registered for the examination.

“Out of this number, 3,949 are male, representing 47.66% while 4,336 are female, representing 52.3% of the total candidature,” he said.

Dangut explained that candidates would be examined in 19 subjects, made up of 26 papers in a hybrid mode.

“Plans have, therefore, been concluded for this first-ever computer-based examination, which will be delivered in hybrid mode. The hybrid mode entails that, the objective or multiple choice questions will be rendered on-screen and candidates are required to give their responses on the screen.

“The essay and practical questions will be rendered on-screen, likewise, but candidates will be required to give their responses using the answer booklets provided,” he said.

He called on candidates to visit WAEC’s e-learning portal for materials that would demonstrate to candidates, the requirements for the conduct of the CB-WASSCE.

“We are set for the conduct of CB-WASSCE for private candidates, in 2024.

“We have and will always work hand-in-hand with the Federal Ministry of Education, the various State Ministries of Education, the Nigeria Police Force, other security agencies and stakeholders, to deliver, as usual, a credible examination to the Nigerian child and the general public,” he declared.

Military airstrikes killed 30 terrorists in Kaduna -NAF
The military air component of Operation Whirl Punch has killed 30 terrorists on motorcycles in the Birnin Gwari Local Government Area of Kaduna state.

The air strikes were ordered by the military following an intelligence report which disclosed the movement of the terrorists in the area.

A statement on Monday by the Director of Public Relations and Information, Air Vice Marshal Edward Gabkwet, said the eliminated terrorists were responsible for the ambush on troops at Kwanan Mutuwa recently as well as several attacks and abduction of innocent civilians in the LGA.

The statement read, “In its relentless campaign to rid the Northwest and Northcentral region of Nigeria of the menace of terrorism and Kidnapping, the Air Component of Operation Whirl Punch has eliminated a syndicate of terrorists in Kaduna State.

“The strike followed an intelligence report of the movement of the syndicate along the Kwiga-Kampamin Doka axis in Birnin Gwari LGA of Kaduna State.

“The intelligence also revealed that the same syndicate was responsible for the ambush on troops at Kwanan Mutuwa on January 27, 2024, as well as several attacks and abduction of innocent civilians in Birnin Gwari.”

He added that when the troops arrived at the location, two armed terrorists were sighted on 15 motorcycles.

He said “On arrival at the suspected location, a deliberate and detailed scan revealed a trail of terrorists sighted moving in a convoy of about 15 motorcycles, each with at least two armed terrorists.

“Accordingly, the terrorists were trailed to a location where they converged before they were engaged and neutralized in a precision strike. The aftermath of the air strike revealed that several of the terrorists were eliminated as a result of the strike.”

Court adjourns Nnamdi Kanu’s N50bn suit against FG till April 22
The Federal High Court in Abuja has adjourned a suit by the leader of the Indigenous People of Biafra, Nnamdi Kanu, against the Federal Government until April 22, 2024.

Kanu in the suit marked FHC/ABJ/CS/462/2022 accused the FG of kidnapping him from Kenya and bringing him to Nigeria for trial.

He also wants an order for his release from the Department of State’s custody.

Kanu asked the court to order the FG to pay him N50bn as damages.

Other reliefs sought by him include, “whether by the operation of Section 15 of the Extradition Act Cap E25, Laws of the Federation of Nigeria 2004, the plaintiff can be competently/legally tried for offences stated in counts 1 to 14 of the 15-count amended charge in charge number FHC/ABJ/CR/383/2015 between the Federal Republic of Nigeria v. Mazi Nnamdi Kanu.

“Whether the way and manner in which the plaintiff was abducted in Kenya and extraordinarily renditioned to Nigeria is consistent with extant laws.”

Particularly, he cited “the provisions of Article 12 (4) of the African Charter on human and peoples rights (ratification and enforcement) Act Cap A9 laws of the Federation of Nigeria, 2004, and Article/Part 5 (a) of the African Charter’s principles and guidelines on human and peoples’ rights while countering terrorism in Africa.”

However, in the preliminary objection filed by the FG and AGF, they described the suit as an abuse of the court process, urging the court to dismiss its process.

The defendants held that Kanu had filed an earlier suit with similar facts before a Federal High Court in Umuahia.

At the proceedings on Monday, Aloy Ejimakor informed the court he had taken over the case from Mike Ozekhome (SAN).

The trial judge, Justice Inyang Ekwo, directed the Ejimakor to find out if a similar matter was not before a sister court or if a judgment had been delivered in a similar suit.

The judge ordered that a hearing notice be issued and served on the defendants who were absent at the proceedings on Monday.

Bandits abduct newly married couple in Zamfara
Bandits stormed Madabanciya village in Bungudu local government area of Zamfara State, on Sunday night, where they abducted a newlywed husband and wife.

An indigene of the area, Ibrahim Sani, said the bandits arrived in the village on foot around 11.45pm on Sunday, leaving their motorcycles outside the village.

Sani said the bandits, who were in large numbers, were wielding sophisticated weapons and immediately they arrived at the village, they began to shoot indiscriminatelg to scare residents.

According to him, the bandits went from house to house in search of food items and other valuables.

He added, “They stole large number of animals, food items and other valuables.

“In the process of going round the village, they came across a newly married couple and took them to the forest.”

Sani said there was no security agent attached to the village to protect the lives and property of the people, despite the security challenges affecting the state.

He called on the authorities to deploy security personnel to the area, concluding that “if something is not done on time, we will be left with no option than to relocate to other places.”

The state Police Public Relations Officer, ASP Yazid Abubakar, could not be reached for comment as of the time of sending this report.

On its part, the state government has concluded arrangements to launch its Community Protection Guards next Wednesday.

They would be deployed to their respective localities to help the security personnel in the fight against banditry.

Zamfara has been facing frequent attacks by bandits, resulting in the loss of lives and the abduction of numerous individuals over the past few months.

In December 2023, bandits invaded Zurmi town, the headquarters of Zurmi LGA of the state, resulting in the loss of one life, injuries to two persons, and the abduction of 15 people.

Also, in November 2023, four communities in Maru LGA were abandoned after 110 people were kidnapped by bandits for not paying a notorious bandit kingpin a monthly levy.

The Nigeria Police Force has said the identities of three officers who stopped a motorist in Lagos to demand his tinted glass permit without their ID cards and uniforms have been known.

The Force Police Public Officer, ACP Olumuyiwa Adejobi, confirmed the development on his verified X handle @princemoye1 on Sunday.

Adejobi, who was reacting to the video posted by an X user, said that the officers had been traced to Zone 2 Command, Onikan, Lagos State.

According to him, the AIG zone 2 is investigating the matter.

The News Agency of Nigeria recalls that an X user, simply identified as @emmCee_RNB, on Friday, narrated how three men who claimed to be police officers from Zone 2 stopped him on Victoria Island and ordered him to enter their vehicle.

He claimed that the men were in mufti and drove a bus with no number plate.

The X user said after he refused to come down from his car, the men demanded to see his tinted glass permit. He demanded to see their identification cards first before complying, but they could not provide any identification cards.

NAN reports that according to him, when he told them he was a journalist, they entered their vehicle and drove off.

“I noticed a white bus with no plate number following my car from the Nigerian Law School down to 1004 Estate before the bus overtook my car just in front of the traffic light at the entrance of the Oriental Hotel.

“Before I could observe what was happening, three men dressed in mufti came down from the bus telling me to come down from my car and enter the bus that one of them would drive my car along.

“All this was happening in the middle of the road while the traffic light was on green and cars were moving past me.

“Afterwards, I told them I couldn’t come down from my car but they should allow me to leave the centre of the road. So they agreed and that was when I started the video recording; unknown to them.

“My shock till now is that they didn’t have any form of identification and only said they are undercover police officers from zone 2 police station in VI. So I couldn’t even tell if they were real or not,” he stated.

Everyone will gradually accept blessings for same-sex couples – Pope
Pope Francis has expressed confidence that those who criticise his decision to allow blessings for same-sex couples will come to understand it over time, except for Africans, whom he referred to as a “special case.”

Reuters reports that Pope Francis stated that Africans perceive homosexuality negatively from a cultural perspective in an interview with Italian newspaper, La Stampa, that was published on Monday.

“Those who protest vehemently belong to small ideological groups. A special case are Africans: for them homosexuality is something bad from a cultural point of view, they don’t tolerate it.

“But in general, I trust that gradually everyone will be reassured by the spirit of the ‘Fiducia Supplicans’ declaration by the Dicastery for the Doctrine of the Faith: it aims to include, not divide,” he said.

Last month, a Vatican document called Fiducia Supplicans (Supplicating Trust), which allowed blessings for same-sex couples, sparked widespread debate in the Catholic Church and around the world.

However, the Vatican made it clear that blessings should not be included in regular church ceremonies or linked to civil unions or weddings.

It emphasised that it continues to view marriage as between a man and a woman.

According to Reuters, last week, Francis seemed to recognise the resistance that the document generated, particularly in Africa, where in some countries, same-sex activity can result in severe consequences, such as imprisonment or even capital punishment.

He said that when the blessings are given, priests should “naturally take into account the context, the sensitivities, the places where one lives and the most appropriate ways to do it.”

The Catholic Bishops Conference of Nigeria announced that Catholic churches within the country will not perform blessings for same-sex unions.

“That would go against God’s law, the teachings of the Church, the laws of our nation, and the cultural sensibilities of our people,” they said in a statement.

According to the bishops, there was a misinterpretation of Pope Francis’s decision to allow the blessing of same-sex marriage.

“The Declaration reinforces the truth about God’s mercy. For one to willingly ask for a blessing demonstrates one’s trust in God and the desire to live according to God’s commandments. Asking for God’s blessing is not dependent on how good one is. Imperfection is the reason for seeking God’s grace.

“Therefore, those in irregular unions are invited never to lose hope but rather to ask for God’s grace andmercy while remaining open to conversion.”

The Nigeria Police Force has declared that officers on stop-and-search duties must be in uniform with their names clearly attached.

The Force Police Public Relations Officer, Muyiwa Adejobi, stated this in a post on his X handle on Monday, while reacting to a video in which four policemen in mufti stopper a driver on Lekki-Epe Express Way.

The officers had approached the man to ask for his tinted permit, but he replied by asking for their identities, saying there was nothing to indicate they were policemen.

But, Adejobi, in his response said the policemen “have been traced to Zone 2 and identified,” adding that “the AIG Zone 2 Lagos is investigating, while the PPRO Zone 2 will speak to it as soon as possible.”

Speaking further, Adejobi said the NPF had ordered that any policeman embarking on routine patrol or stop-and-search must be in uniform, properly dressed, and easily identified.

He maintained that it is not ideal to be on patrol while in mufti, saying policemen misbehave when they know their identities are hidden and unknown.

“You will recall that we have ordered and announced that any policeman embarking on routine patrol or stop and search must be in uniform, properly dressed, and easily identified. It’s not ideal to carry out a stop and search in mufti.

Uzodinma, 14 other governors under scrutiny for LGA Administration breach
At least 15 governors are in breach of Section 7 of the 1999 Constitution of the Federal Republic of Nigeria, as amended, DAILY POST findings have shown.

They include Benue, Kwara, Cross River, Anambra, Akwa Ibom, Abia, Kogi, Osun, Plateau, Imo, Ondo, Bayelsa, Yobe, Bauchi and Sokoto states.

Section 7 of the Constitution aptly provides that “The system of local government by democratically elected local government councils is under this Constitution guaranteed; and accordingly, the government of every state shall, subject to Section 8 of this Constitution, ensure their existence under a Law which provides for the establishment, structure, composition, finance and functions of such councils.”

DAILY POST findings show that at the moment, no fewer than 14 governors obtained approvals from their respective state Houses of Assembly and constituted caretaker committees in place of elected chairmen.

Late last year, the Senate asked the Federal Government to block statutory allocations to any local government council not democratically elected.

The Red Chamber unanimously resolved that this move would deter the dictatorial tendencies of state governors.

The resolution was sequel to a motion moved by Sen. Abba Moro on the urgent need to halt the erosion of democracy vis-a-vis the dissolution of elected councils in Benue State.

The lawmakers argued that the placement of Caretaker Committees to replace Elected Councils is an aberration, undemocratic and a breach of the constitution of the Federal Republic of Nigeria (as amended).

Senator Victor Umeh (representing Anambra Senatorial district), who seconded the motion, lamented that the issue has continued to undermine the local government system in Nigeria.

Consequently, the Senate condemned the arbitrary dissolution of democratically elected local government councils in Benue and other federation states.

To save the face of Nigeria’s democracy, the Senate urged Alia to adhere to his oath of office, obey the rule of law, review the constitution of caretaker committees, and reinstate the elected councils.

But Alia is not alone on this. Many of his colleagues are involved in the said unlawful act.

Many concerned Nigerians are worried that despite the clear provision of the constitution and even court judgements, the governors have continued to observe that section in breach.

Several court pronouncements have held that the use of caretaker committees was in conflict with section 7(1) of the 1999 constitution.

However, even some of the governors who used the conduct of local government elections as part of their campaign promises, reneged once they got elected into office.

This is not the first time efforts have been made to preserve the constitutional roles of the local government councils.

It could be recalled that former president Muhammadu Buhari had at a time signed an executive bill mandating the direct payment of statutory allocation to the state judiciary, legislature and the local government councils.

Till date, many state governors are hellbent on running the council areas with caretaker committees.

Evidence of corporate malfeasance is said to abound in the handling of LG funds by many governors, with the local government chairmen always crying in silence for fear of victimization.

The Socio-Economic Rights and Accountability Project, SERAP, does not agree less.

Like many other Nigerians, it is worried over the level of financial sleaze being perpetrated with the local government system.

In a Freedom of Information, FOI, request signed by SERAP’s deputy director, Kolawole Oluwadare, the organisation is urging the Independent Corrupt Practices and Other Related Offences Commission, ICPC, and the Economic and Financial Crimes Commission, EFCC, to investigate the actual disbursement and spending of federal allocations meant for local governments in the states and the FCT since May 1999.

SERAP also agreed that the governors pocket a larger chunk of the money allocated to the LGAs on a monthly basis.

It expressed sadness that “allegations of corruption and mismanagement of federal allocations meant for local governments have contributed to widespread poverty, underdevelopment and lack of access to public goods and services in several states.

“According to our information, the 36 states in Nigeria and the federal capital territory, Abuja, have collected over N40 trillion federal allocations meant for the 774 local governments areas in the country and FCT.

“SERAP notes that former president Muhammadu Buhari recently alleged that state governors routinely pocket or divert federal allocations meant for local governments areas in their states.

“According to Buhari, ‘If the money from the Federation Account to the State is about N100 million, N50 million will be sent to the chairman but he will sign that he received N100 million. The chairman will pocket the balance and share it with whoever he wants to share it with.’”

However, many Nigerians, including the Senate, feel the time has come for the federal government to take decisive action against the recalcitrant governors.

Some observers say the Houses of Assembly deserve more knocks as they aid and abet the illegality instead of chastising the governors.

Professor Frank Asogwa of the Enugu State University of Science and Technology, ESUT, has strong words for the governors.

The professor of law described the action of the state chief executives as an affront to the constitution, stressing that it stifles democracy.

“It is not just unconstitutional but illegal in the sense that the Supreme Court has made a pronouncement on that issue and declared caretaker committees of local government areas illegal,” he told DAILY POST in an interview.

Asogwa added that, “If you do not have a democratically elected local government system, then you are in breach of Section 7, which says that a democratically elected system of local government must at all times be maintained.

“You cannot have democracy at the federal level, democracy at the state level and fail to also have democracy at the third tier of government, even though as an academic I don’t believe there is a third tier of government.

“There are just two tiers- federal and state governments, because the other one is an appendage of state, that is why the constitution said a democratically elected local government system must be assured by who- by the state government.

“That’s why the state governor appoints the chairman of the state electoral commission and this chairman in consultation with the governor, who is the chief executive, determines when, how and if local government elections will be held.

“So, it is not right actually because it stifles democracy at that level.

“Elections at the federal and state levels do not depend on the whims and caprices of who is the head of state, the president of Nigeria or who is the governor.

“There is an independent umpire we know as INEC that organises elections for both federal and state. So, why is SIECs not that independent to say after two years, depending on the state, we are going to conduct an election in the local government?”

The university don, who served as commissioner for local government during the administration of ex-governor Sullivan Chime in Enugu State, equally blamed the sad development on governors’ desire to divert funds meant for the local governments.

He said, “The other reason which is not always spelt out is that the governors who don’t hold elections find it convenient to divert local government funds.

“There has been so much talk about the autonomy of the local government, not just in terms of exercise of power, but autonomy in terms of budgetary provisions and allocations coming straight from the FAAC.

“But some governors opposed it; they don’t want it, because it is convenient for them that the money comes into a central purse and then they decide what goes to the local governments; for some, they allow the funds go to the local governments and determine how much they pay back to the state coffers and they call it joint account or whatever, which is unconstitutional.

“The constitutional thing is what I did when I was commissioner for local government in Enugu State. The law established the State Economic Planning Commission.

“All the local government chairmen are supposed to be members because the law is there; I was there as a member of that commission by virtue of my portfolio as local government commissioner; we had the commissioner for finance, the commissioner for works, we had commissioner for planning Enugu State and other commissioners who were relevant to the development of the local government system.

“At that level, we took decisions on projects affecting local governments; that was how the Nike-Ugwuogo-Opi-Ikem Road was built, because Nsukka, Isi-Uzo and Enugu East Local Government contributed 10 per cent of the fund for the building of that road and the state government contributed 70 per cent.

“I did a memo to the state executive council that time suggesting this ratio and it was approved.

“If any governor is sincere about local government funds, he should go through the Economic Planning Commission, where the local government chairmen are also members and introduce projects.

“So many governors are reluctant to remove their grip on the local government system in spite of what the constitution says.

“In different fora, I have asked this question to state representatives- how would you feel if the federal government strangles the state governments the way they are doing the local system? And they have no answer.”

He, however, said the Senate motion was not enough to end the illegal activities of the governors.

According to him, “the Senate should back it up with a law; the local government system is a creation of law so you cannot by resolution dictate what should happen to them. It will be illegal also to do so; two wrongs cannot make a right.

“If the National Assembly feels very strongly about what the governors are doing, let somebody propose a bill which should be passed at both the Senate and the House of Representatives.

“It’s just like local government autonomy, let them have a strong law backing it up. When that happens, a local government can challenge a governor if he does anyhow, but they cannot do it now for fear of being removed.

“In my conclusion, I repeat that the practice of not holding local government elections is unconstitutional, it is illegal and an affront to democracy in this country.”

Also Airing his views, a former member of the Enugu State House of Assembly, Rt Hon Chinedu Nwamba told DAILY POST that it was wrong for governors to remove elected chairmen and councillors merely because they are not from the same political party.

He equally said the conduct of local government elections was mandatory except in special circumstances.

While using Enugu as a case study, Nwamba said, “there is a court order, for other states, I don’t know what the problem is.

“But in Enugu, from the time of Sullivan Chime, there has always been elected local government chairmen, it only happened in a few cases during the Ifeanyi Ugwuanyi administration when there was a little break and they had caretaker for a few months and after that, election was conducted.

“I’m sure the incumbent governor will also conduct local government elections.

“Coming to other states, I don’t know the reasons given to the Houses of Assembly to expressly approve caretaker committees; their own case might be different from that of Enugu.

“Another school of thought says the governors may want to be in control of the funds of the local governments and that is why they are using caretaker, because once there are elected chairmen and councillors, the councillors now approve the budget of the local government.

“The constitution said the state government through the House of Assembly should supervise the local governments but that should not amount to non-conduct of elections; they also have a joint account, which is JAAC; apart from that, I will say that the local government should fully be on their own, that is where the lacuna is.”

He also said the dissolution of elected chairmen by new governors was equally illegal.

“It is totally unconstitutional and the Houses of Assembly should not approve of it; if an elected local government chairman is in office and a governor comes in, maybe they are not from the same political party, and the governor dissolves them, it is not right.

“There are reasons for an elected chairman to be removed and there are procedures and measures. It is either through impeachment, resignation by himself or he got another appointment.

“So, it is not constitutional to remove an elected chairman or councillor just because the person is not in the same political party with the governor.”

On his part, a rights activist, Barr Olu Omotayo accused the various state Houses of Assembly of promoting illegality.

Omotayo, the President of the Civil Rights Realisation and Advancement Network, CRRAN, said the state lawmakers err in law when they approve caretaker committees for governors despite the clear provisions of the constitution and the Supreme Court judgements.

The lawyer was concerned that the state lawmakers who should sanction the governors for breaching Section 7 of the Constitution were the same ones approving the illegal caretaker committees.

He advocated for citizens’ awareness and action.

According to him, “some of these things, the citizens have concentrated so much attention on the federal unlike in advanced countries, where people focus more on the grassroots

“So, the mentality over the years, we used to focus on the federal government without asking questions, forgetting that development only comes from the grassroots.

“Democracy was brought, this federalism was brought so that from the grassroots it goes up, but we are turning it upside down, we believe it is from up to down.

“And the American model we are using, it is from down you go up; many people in America don’t even know who is their president but they know their councillor; if they have any complaint, they go to their councillor.

“Until we change that mentality and start asking questions, local governments will not function.

“It is a constitutional provision; postponing elections when there is a constitutional provision that there must be local government is a grave infraction on the constitution.

“Only that the citizens have not been living up to expectations in this democracy; the constitutional provision is mandatory, the democratically elected local governments must be there.

“When you postpone elections, who will be operating? The Supreme Court has ruled that caretaker committees they are appointing are unknown to law.

“You cannot continue illegality in a democracy and think that things will work well.”

On the role of the state lawmakers, Omotayo said, “whatever they are doing is illegal because if the constitution says there must be elected local government, if they make a law or approvals contradictory to the constitution, the position of the law is that the constitution must prevail.

“Whatever law they make is null and void to the extent of its inconsistency with the constitution. So, whatever they are making is unlawful and unconstitutional.”

Reinforcing this stand, the President of the Nigeria Union of Local Government Employees, NULGE, Ambali Akeem Olatunji, identified corruption as the primary impediment to the realisation of local government autonomy in the country.

Olatunji, who spoke during his visit to Taraba State attributed the resistance to change to those benefiting from corruption.

He emphasised that the persistent challenges in local government administration stem from certain political actors in states who engage in the pilfering, diversion, and theft of local government allocations.

He also identified a flaw in the 1999 Constitution, which he said placed the local government areas under the state Houses of Assembly.

He accused state legislatures of being coerced by various state governments to enact illegal laws.

Highlighting the constitutional guarantee of democratically elected leaders, Olatunji denounced the appointment of caretakers.

He said, “NULGE is now advocating for federal intervention in states that refuse to conduct local government elections.

“We are proposing the seizure of local government allocations by the federal government.”

He said salaries should be directly deposited into workers’ accounts using the National Identification Number, NIN.

DAILY POST reports that some of the states running the local government councils with elected chairmen include- Ebonyi, Enugu, Delta, Kaduna, Adamawa, Niger, Nasarawa, Lagos, Ogun, Yobe, Kebbi, Jigawa, Katsina, Kano, Rivers, Oyo, Edo, Delta, Borno and Ekiti.

Below are some of the governors who seem unwilling to conduct council polls:

ANAMBRA

Anambra is one of the worst states in terms of non-conduct of local government elections.

No wonder the people of the state were delighted when the incumbent governor, Prof Chukwuma Soludo, while campaigning for the position in 2021, promised a speedy conduct of elections at the grassroots.

The last local government election in the state was held during the twilight of the Peter Obi administration in January 2014.

Many had blamed him for remembering to do so only when his administration was winding up, but at least he did.

For eight years, former governor, Chief Willie Obiano failed to conduct the election, heightening the quest for it.

During the last governorship election in the state, it was obvious that only one who supported the conduct of the election may get the people’s votes.

Prof Soludo cashed in on that. He promised that if elected, the local government election would be one of his priorities.

On March 17, Soludo will be two years in office. There has been constant prodding by opposition parties for the governor to hold election, but many believe that there is nothing on ground to show that Soludo is ready for it.

While there is no constituted electoral body, the lawmaker representing Awka South 1 constituency in the House of Assembly, Henry Mbachu, during the presentation of the 2024 budget, lamented the absence of budgetary allocation for the conduct of LG polls.

He said: “Going through the budget estimate presented, it is glaring that there are no intentions of conducting LGA elections next year (2024).

“On page 475, the budget for the Anambra State Independent Electoral Commission for this current year was N89,120,000, while the projected estimate for the incoming year is N129,120,000.

“You find out that there’s no feasibility or readiness for local government elections for the incoming year. I worry so much because this tier of government has suffered so much because of a lack of local government elections.”

Meanwhile, a human rights activist, Mr Kenechukwu Kodili, who spoke to DAILY POST, lamented that Soludo was already disappointing the people by reneging on the conduct of local government elections in the state.

He said: “For close to two years of being the governor, all he (Soludo) does is renew the tenure of the caretaker local government chairmen every three months.

“That was not what he promised the people. He was himself elected into the governorship seat, he should also conduct elections to elect local government chairmen, not to keep renewing the appointment of those he appointed.”

KWARA

For the past four years, the Kwara State government has administered local government areas with caretaker committees.

It could be recalled that the democratically-elected council chairmen were sacked in 2019 by the All Progressives Congress-led government, triggering a legal dispute that terminated at the Supreme Court.
